Ubay-Ubay artist acceptance letter

1. Who this agreement is between

This letter is an agreement between you, the artist who signs below, and Tinkers, an organization in the Fine Arts department of the University of the Philippines Cebu. Tinkers runs Ubay-Ubay, a pop-up art market and fundraiser. In this letter, "we", "us", and "Ubay-Ubay" mean Tinkers.

You join as an independent artist. Joining does not make you a member, officer, or employee of Tinkers, and it is free. You never pay us anything.

Signing this letter is how you sign up. We review every sign-up and will email you within 1 to 3 business days to let you know if you are in.

2. What you send us

• A bundle: 4 pin designs and a bundle name logo.
• Each design as a PNG file, 1000 x 1000 px, made to fit the pin template on the website.
• Optional: solo pins, if you have also sent a bundle.

If you are in, we will email you a private upload link, and you send your files through it on the Ubay-Ubay website. A FASO artist designs the backcard for every bundle. Your artist name and social handle are printed on it.

3. Deadlines and printing

The deadline is the last day of every month. Designs we receive by then are reviewed and, if accepted, printed and packed the following month. Designs that arrive later count for the next month. We will tell you when your bundle goes on sale.

We pay for printing, packing, the backcard, and selling. You get 1 free copy of each of your bundles. We decide how many copies to print, and we cannot promise how many will sell.

4. Earnings and payout

You earn a share of every sale of your bundles and solo pins. Before your bundle is first printed, we will email you its selling price and your share. If you do not agree with them, you may withdraw before printing, and nothing of yours is printed.

We will announce by email, before your first sale, when and how you are paid. Each payout comes with a count of how many of your items sold. We will ask for your payout details (such as GCash) only then, and only if you have sales.

If we ever change the price or your share, we will email you first. The change applies only to copies printed after that, and you may withdraw if you do not agree.

5. Your art stays yours

You keep the copyright to your designs. You may keep using and selling them anywhere, in any form, including other pins. By signing, you give Ubay-Ubay permission to:

• print your designs as button pins and bundle cards
• fit them to print, such as resizing, cropping to the pin template, and adjusting colors
• sell them wherever Ubay-Ubay sells, in person and online
• show your designs, artist name, and social handle in posts and photos that promote Ubay-Ubay

This permission is not exclusive, and it lasts until you ask us to stop (see clause 8). We will always credit you as the artist, and we will not change your art beyond fitting it to print.

6. Original work and fan art

You confirm that you made your designs yourself and did not copy or trace another artist's work. Fan art is welcome. If a design shows characters, logos, or people you do not own, you take responsibility for it, and we may take it off sale if the owner objects or if we think it is a risk.

7. Choosing designs

We review every design before printing. We may accept it, ask you for changes, or decline it, for example for print quality, fit to the template, or content that is offensive or harmful. A declined design is not printed and stays fully yours.

8. Stopping

You may stop at any time by emailing ubayubaytinkers@gmail.com. Once we receive it, we will not print new copies of your designs. We may still sell copies already printed, and you still get your share of those sales. Promotional posts already published may stay up.

We may also retire a bundle or end this agreement at any time. If we do, we will tell you by email and pay you any share you are still owed.

9. Your personal data

Under the Data Privacy Act of 2012 (Republic Act No. 10173), you have a right to know how we handle your personal data.

• What we collect: your full name, artist name, email, social handle, signature, the date you signed, and your designs. Later, payout details, only if you have sales.
• Why: to run this agreement. That means to contact you, receive and review your designs, credit you on backcards and in posts, count your sales, and pay you.
• Who sees it: the Tinkers officers who run Ubay-Ubay. Your artist name, social handle, and designs are public, because they are printed on the backcard and shown in posts. Everything else stays private.
• Where it is kept: in the Ubay-Ubay Google account (Google Drive and Google Sheets). We do not sell or share your data with anyone else, unless the law requires it.
• How long: while you are in the program, and up to 2 years after your last payout or after you stop, whichever is later. Then we delete it.
• Your rights: you may ask to see, correct, or delete your data, or object to how we use it, by emailing ubayubaytinkers@gmail.com. You may also file a complaint with the National Privacy Commission.

10. Signing

You sign this letter by drawing your signature below. Under the Electronic Commerce Act (Republic Act No. 8792), this signature is as valid as one on paper. By signing, you confirm that:

• you have read this letter and agree to it
• the details you give are true
• if you are under 18, your parent or guardian knows about this agreement and allows it

This agreement starts when you sign. You will receive a signed copy by email. If we update this letter, we will email you, and the update applies only to bundles you send after that, unless you agree otherwise. This agreement follows the laws of the Philippines. If a problem comes up, we will first try to settle it by talking it through.
